Terms for using Nuqtaty

By creating an account, accepting a staff invitation or using the platform, the user accepts these terms and the privacy policy. The person creating a business account must be authorised to represent it and must provide accurate, current information.

• The owner manages staff invitations, roles and removal of access.
• Each user must protect sign-in details, sessions and verification codes.
• Users must not bypass permissions or access another business or customer without authority.
• We may require additional verification or restrict a session where there is a reasonable security or fraud risk.

Nuqtaty lets a business configure a loyalty programme, issue Apple Wallet or Google Wallet passes, record stamps, balance and rewards, manage staff and messages and review authorised data. The merchant sets programme rules and supplies the promised goods, services, rewards and prepaid value. Nuqtaty supplies the technology and does not become the guarantor of a merchant promise to its customer.

• The accepted offer or order for that account states the price, billing cycle, tax and any trial period.
• Trial length and conditions may vary by offer; these terms do not promise a fixed 30-day trial.
• If renewal applies, its cycle is shown in the offer or invoice. Material changes are notified where required.
• Until the product expressly confirms completion of self-service cancellation, request renewal cancellation at info@nuqtaty.com. Uninstalling or stopping use does not cancel automatically.
• There are currently no iOS In-App Purchases. Future digital features sold in the app will use Apple In-App Purchase where Apple's rules require it.

Requests are assessed under the accepted order, service already supplied, our Cancellation and Refund Policy and non-excludable consumer rights. The subscription includes a money-back guarantee for the first 60 days from the start of the trial, including the first 3 free days. Contact support within that period for a full refund of platform subscription fees paid during it.

The customer retains rights in personal data; it does not become the property of Nuqtaty or the merchant. The merchant is normally controller for its loyalty programme and Nuqtaty its processor under the Data Processing Addendum. Nuqtaty controls account, platform-security, billing and Nuqtaty-site analytics data under the Privacy Policy.

• Merchants must request only necessary data and give a clear notice and valid legal basis.
• A QR scan, pass installation or store visit is not marketing or location-tracking consent.
• Marketing consent must be separate, freely given, recorded and easy to withdraw.
• Sensitive health, detailed financial or similar data must not be put in free-text fields without written approval and the required legal controls.

Merchants must display earning, expiry, redemption and balance rules before sharing a pass and record only genuine operations. Value paid to a merchant remains that merchant's obligation; Nuqtaty does not hold the funds merely by displaying the balance. See the Loyalty and Balance Terms.

• Do not violate law or individual rights or send misleading, abusive or unsolicited content.
• Do not fabricate visits, stamps, redemption or balance or evade system limits and permissions.
• Do not scrape, security-test or disrupt the service without written authorisation.
• Do not use balance as a general transferable or cash-out payment instrument without the required regulatory approvals.

Features depend on Apple Wallet, Google Wallet, Supabase, Vercel, Resend and providers listed at Service providers. Their services have separate terms and may change outside our control. Apple and Google do not sponsor or guarantee a merchant programme.

Nuqtaty and its licensors retain rights in the platform, software and brand. A merchant retains rights in its logo, images and copy and grants us a limited licence to host and display them to operate its passes. The merchant warrants that it has the right to upload that content.

Access may be restricted proportionately for a security risk, non-payment, material breach or binding order. Where safe and permitted, we try to notify the merchant and allow correction. Stopping renewal and deleting the account are different. Deletion can be started in the iOS app or as described at Account deletion, subject to outstanding prepaid value and legally required records.

We use reasonable care to operate and repair the service but do not promise uninterrupted availability or permanent compatibility with every device or third-party service. To the extent permitted by law, we exclude indirect loss and expected-profit loss caused by matters outside our reasonable control. Nothing excludes liability or consumer rights that cannot lawfully be excluded.

Material changes are presented before taking effect when required. Silence is not treated as consent to a new purpose requiring separate consent. Saudi Arabian law governs and its competent authorities and courts have jurisdiction, without removing mandatory complaint or settlement rights.
